1. Introduction
Welcome to Forequestrian.com. These Terms and Conditions (“Terms”) govern the posting of advertisements (“Ads”) on our website, including both standard (free) Ads and enhanced (paid) Ads. By posting an Ad, you agree to comply with these Terms in their entirety. If you do not accept these Terms, please refrain from posting Ads.
2. Types of Ads

Standard Ads: Free to post. Subject to the rules described in these Terms.
2.2
Enhanced / Paid Ads: Ads for which payment is required in order to access features such as improved placement, AI-generated text enhancements, and additional promotion on social media platforms.
3. User Accounts
You must have a registered user account to post Ads. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Ad Content
4.1
Accuracy: All Ads must be truthful and accurate. You are responsible for ensuring that the content of your Ad, including text, images, and any AI-generated content, accurately represents the item or service offered.
4.2
Prohibited Content: Ads must not contain offensive, misleading, or illegal content, including discriminatory, defamatory, obscene, or infringing materials.
4.3
Compliance: All Ads must comply with applicable local, state, federal, and international laws.
5. Ad Placement and Duration
5.1
Placement: Forequestrian.com determines the placement of Ads on the website. Enhanced Ads may receive priority placement and additional visibility.
5.2
Duration: Ads will remain active for the period specified at the time of posting. Ads may expire automatically unless renewed or upgraded.
6. Promotion of Ads
By posting an Ad, you grant Forequestrian.com a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display your Ad content for promotional purposes.
Forequestrian.com may, at its sole discretion, promote any Ad, including AI-generated text, images, and descriptions, on social media platforms such as TikTok and Instagram, as well as through email communications and newsletters sent to subscribers who have opted in to receive updates about new Ads.
Such promotion is provided free of charge for Standard Ads and as part of the features for Enhanced Ads. No compensation will be provided for promotional activities, and no guarantee is made regarding placement, visibility, or performance.
7. Payments for Enhanced Ads
7.1 Payment is required prior to posting or promoting Enhanced Ads.
7.2 Accepted payment methods: Stripe and PayPal.
7.3 By providing payment information, you authorize Forequestrian.com to charge the applicable fees. If payment fails, Forequestrian.com may suspend or cancel the Enhanced Ad.
8. Rights and Responsibilities
8.1
User Rights: You retain ownership of your Ad content but grant Forequestrian.com the license described above.
8.2
User Responsibilities: You are responsible for ensuring that your Ad does not violate third-party rights, including copyright, trademark, or privacy rights.
9. Removal of Ads
Forequestrian.com reserves the right to remove any Ad at its sole discretion, including Ads that violate these Terms, are inappropriate, or receive complaints. No notice or explanation is required for removal.
10. Limitation of Liability
Ads are provided “as is.” Forequestrian.com is not liable for direct, indirect, incidental, consequential, or special damages arising from the use, removal, or promotion of Ads.
11. Changes to Terms
Forequestrian.com may modify these Terms at any time. Changes will be posted on this page and take effect immediately. Continued use of the Ad posting service constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York.
13. Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms, the Ads, or your use of Forequestrian.com shall be resolved exclusively through final and binding arbitration, except that either party may bring qualifying claims in small claims court.
The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) and take place in the State of New York.
You agree that arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitrator’s decision is final and binding.
